We are planning to use the SMART provided/hosted SMART Connect service. Our database includes third-party data that we have signed an NDA (non-disclosure agreement) for. Can we still use the hosted SMART Connect service?

We can’t offer legal advice and the answer will depend on what your NDA says. However, any well-written NDA allows you to share data with third parties provide the use is within the intended purpose of the NDA and the third parties are subject to the same terms and conditions. The SMART Connect hosting agreement limits SMART to only access your set up only for the purpose of providing the service and does not allow us to access you data. So in short, provided you have a well written NDA with your third parties, you should have no problem using the hosted Connect service.
